In these Terms and Conditions, the following definitions apply:

• "GuardianAI", "we", "us", or "our" refers to GuardianAI (Pty) Ltd, a company registered in South Africa.
• "Service" or "Services" refers to the AI-powered security monitoring and alert system provided by GuardianAI, including all related software, applications, and support.
• "User", "you", or "your" refers to any individual or entity that accesses or uses our Services.
• "Account" refers to the user account created to access and use our Services.
• "Content" refers to any images, data, or information processed through our Services.
• "Subscription" refers to the paid plan that grants access to our Services.

GuardianAI provides AI-powered security monitoring services that integrate with your existing CCTV camera systems. Our Services include:

• Real-time AI analysis of motion-triggered images from compatible security cameras
• Human detection and classification to reduce false alarms
• Instant alert notifications via Telegram messaging platform
• Scheduling and arming/disarming functionality
• Integration support for compatible camera systems

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time with reasonable notice to affected users.

To use our Services, you must create an account and provide accurate, complete information. You agree to:

• Provide truthful and accurate registration information
• Maintain the security and confidentiality of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account
• Not share your account credentials with third parties

You must be at least 18 years old to create an account and use our Services. By registering, you represent and warrant that you meet this age requirement.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or harmful activities.

Access to GuardianAI Services requires a paid subscription. By subscribing, you agree to the following payment terms:

• Billing Cycle: Subscriptions are billed monthly in advance on the date of your initial subscription.
• Currency: All prices are quoted in South African Rand (ZAR) unless otherwise specified.
• Payment Methods: We accept payment via credit card, debit card, EFT, and other methods as indicated during checkout.
• Price Changes: We may adjust pricing with 30 days' notice. Continued use after a price change constitutes acceptance.
• Failed Payments: If payment fails, we may suspend your service until payment is received.

You agree to use our Services only for lawful purposes and in accordance with these Terms. You must not:

• Use the Services for any unlawful or fraudulent purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the integrity or performance of our Services
• Use the Services to monitor areas where individuals have a reasonable expectation of privacy without proper consent
• Reverse engineer, decompile, or attempt to extract the source code of our software
• Resell, redistribute, or sublicense our Services without written authorization
• Use the Services in any manner that could damage, disable, or impair our systems

You are solely responsible for ensuring that your use of security cameras and monitoring services complies with all applicable laws, including privacy laws and regulations governing surveillance in your jurisdiction.

Your privacy is important to us. Our handling of your data is governed by the following principles:

• Image Processing: Images are processed for AI analysis and then immediately discarded. We do not store your camera footage.
• Data Security: All data is encrypted in transit and processed on secure servers located in South Africa.
• POPI Compliance: We comply with the Protection of Personal Information Act (POPIA) and applicable data protection laws.
• No Third-Party Sharing: We do not sell or share your personal data with third parties for marketing purposes.
• Data Retention: Account information is retained only as long as necessary to provide our Services and comply with legal obligations.

All intellectual property rights in our Services, including but not limited to software, AI models, algorithms, designs, trademarks, and content, are owned by or licensed to GuardianAI.

Your subscription grants you a limited, non-exclusive, non-transferable license to use our Services for their intended purpose. This license does not include the right to:

• Copy, modify, or create derivative works based on our Services
• Use our trademarks, logos, or branding without written permission
• Access or use our AI models or algorithms for any purpose other than receiving our Services

You retain ownership of any images or data you submit through our Services. By using our Services, you grant us a limited license to process this content solely for the purpose of providing the Services.

To the maximum extent permitted by law:

• GuardianAI provides Services on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
• We do not warrant that the Services will be uninterrupted, error-free, or that all security threats will be detected.
• GuardianAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.
• Our total liability for any claims arising from these Terms or your use of the Services shall not exceed the amount you paid to us in the 12 months preceding the claim.

Termination by You: You may cancel your subscription at any time through your account settings or by contacting our support team. Cancellation will take effect at the end of your current billing period.

Termination by Us: We may suspend or terminate your access to the Services immediately if:

• You breach any provision of these Terms
• You fail to pay applicable fees
• We are required to do so by law
• We reasonably believe your use poses a security risk

Effect of Termination: Upon termination, your right to use the Services will cease immediately. We may delete your account data in accordance with our data retention policies. Provisions of these Terms that by their nature should survive termination will remain in effect.

Governing Law: These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.

Entire Agreement: These Terms, together with our Privacy Policy and any other legal notices published on our website, constitute the entire agreement between you and GuardianAI.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

Amendments: We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through our Services. Your continued use after changes take effect constitutes acceptance of the modified Terms.
